Terms of Service

You may use SpinFreeze only if you are at least 13 years old (or the minimum age required by applicable law), have the legal capacity to agree to these Terms, and provide accurate registration information.

You are responsible for maintaining the confidentiality of your credentials, restricting access to your account and device, and notifying us if you suspect unauthorized use.

SpinFreeze may offer sign-in via email and password, Google Sign-In, Sign in with Apple, or other methods we support in the future. We may require re-authentication, verification, or additional security steps for certain account actions.

SpinFreeze is a recipe, freezer-tracking, and community application focused on frozen treats. Features may include recipe creation and publishing, freezer and spin tracking, ingredient and nutrition workflows, public profiles and community discovery, moderation and safety features, and optional premium subscriptions.

We may add, remove, change, or discontinue features at any time, subject to applicable law.

If you publish content on SpinFreeze, certain information may be visible to other users, including your username, display name, bio, published recipes, recipe photos and related metadata, public collections, and engagement indicators such as follows, likes, or saves.

Published content may appear in search results, feeds, recommendations, public profile pages, and other discovery surfaces. Do not publish content you expect to remain private.

Published recipes and related public information may be displayed on publicly accessible web pages hosted at spinfreeze.com (for example, a shareable recipe page at a /recipe address). These pages can be viewed by anyone with the link, do not require a SpinFreeze account or the SpinFreeze app to view, and are intended to be shareable on the open web.

Because these pages are public, they may be discovered, crawled, indexed, cached, summarized, and displayed by third parties outside our control, including search engines, AI and large language model systems, and social or messaging platforms that generate link previews. Such previews and listings may show your recipe title, description, photo, creator name or username, and structured recipe details. We may also list published recipes in sitemaps or similar files to support discovery.

You control whether your content is published. If you unpublish or delete a recipe, we will stop serving its public page going forward, but we cannot guarantee removal of copies already cached, indexed, shared, or stored by third parties. Do not publish content you are not comfortable making publicly available on the open web.

You retain ownership of all recipes, photos, and other content you submit to SpinFreeze. SpinFreeze does not claim ownership of your user-submitted content.

Recipe ingredient lists and basic preparation steps are generally not protected by copyright under U.S. law. Creative expression in recipe descriptions, photos, and original written content may be protected.

By submitting or publishing content, you grant SpinFreeze a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, process, moderate, index, and use your content as needed to operate and improve the service — including search and discovery, moderation and safety review, AI-assisted product features, backups, enforcement, and abuse prevention.

When you publish a recipe, you also grant SpinFreeze a non-exclusive, worldwide, royalty-free license to feature that published recipe and its public elements — including its title, photos, nutrition data, and your username — to promote and market SpinFreeze, including in SpinFreeze's own promotional materials and on its official social media and other channels. This may include generating our own promotional images or share cards from those elements. When we feature your published recipe this way, we attribute it to your username. If you unpublish or delete the recipe, we stop featuring it in new promotional materials going forward, though we cannot guarantee removal of materials already published or shared.

These licenses exist so we can provide, improve, and promote the service. If you delete your content or account, they end as described above, except for content already shared by others, cached copies, or records retained for legal or safety reasons as described in our Privacy Policy.

You represent that you have the rights needed to submit the content you upload and that your content does not infringe anyone else's intellectual property rights.

You agree not to use SpinFreeze to:

• violate any law;
• infringe any person's intellectual property, privacy, or other rights;
• submit explicit sexual content, nudity, or sexually suggestive content;
• submit child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors;
• submit violent, graphic, hateful, harassing, or discriminatory content;
• promote illegal acts, violence, or self-harm;
• upload misleading, deceptive, or clearly off-topic content;
• interfere with SpinFreeze's security, monitoring, analytics, moderation, or anti-abuse systems;
• misuse premium features, billing flows, or restore mechanisms;
• attempt to game or manipulate AI-powered tagging or similar systems.

Photos uploaded to SpinFreeze should relate to frozen treats, ingredients, or the recipe-making process — finished frozen treats, ingredients, preparation or spinning process photos, and plating or serving presentations.

Photos that are explicit, violent, hateful, misleading, or clearly unrelated to the platform may be rejected. Photo review is primarily automated, though limited manual review may occur for support, safety, abuse prevention, or appeals.

You may add previously-taken spin photos from your private spin log to your recipes. When you add a spin photo to a published recipe, that photo becomes visible to other users. Photos approved during the original spin log upload do not undergo additional review when added to a recipe.

SpinFreeze uses automated systems and, where appropriate, human review to monitor compliance with these Terms. Content may be reviewed when you publish recipes, update a profile, upload photos, submit a report, or file an appeal.

Subject to applicable law, we may take enforcement action when we reasonably believe content or conduct creates safety, legal, platform, or community risk. Possible actions include hiding content from search or public feeds, restricting publishing or community features, and suspending or terminating accounts.

If you believe content was moderated in error, you may submit an appeal through the app. Appeals may be limited if they are abusive, repetitive, or made in bad faith. Subject to applicable law, decisions on appeals are generally final.

Child Safety

SpinFreeze has a zero-tolerance policy for child sexual abuse material (CSAM) and any content that sexually exploits or endangers minors. Uploaded images — including recipe photos and support screenshots — are automatically scanned for sexual content and other prohibited material; content that violates this policy is rejected or removed.

Upon obtaining actual knowledge of apparent CSAM, SpinFreeze will report it to the National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. § 2258A, and may also report it to relevant law enforcement authorities. We may preserve related records and disclose information to authorities as permitted or required by law. Accounts involved in such violations will be terminated.

Separately from safety review, automated systems may also check whether a published recipe's text and photos, and newly uploaded photos, are topically relevant to SpinFreeze (for example, whether they actually relate to frozen treats or the Ninja Creami). Content that is off-topic may be hidden or rejected.

SpinFreeze may use AI-powered features, including:

• recipe tagging and discovery metadata;
• nutrition-label extraction from images;
• ingredient photo recognition (identifying food products from a photo);
• Recipe Importer (URL fetch and screenshot parsing into spin-ready recipes);
• automated content-relevance classification (assessing whether published recipes and uploaded photos are on-topic for frozen treats);
• related automated product assistance features.

Free vs. Premium AI Features

SpinFreeze offers AI features across both free and premium tiers:

• Free: recipe tagging (Google Gemini), nutrition-label extraction, and a small number of trial imports per account via Recipe Importer.
• Premium: continued Recipe Importer use beyond the free trial quota, with a monthly import limit.

By using these features or publishing relevant content, you acknowledge that certain content may be processed by SpinFreeze's internal systems or by third-party AI services. Recipe tagging, nutrition-label extraction, ingredient name formatting, and ingredient photo recognition use Google Gemini. Ingredient photo recognition also uses OpenAI moderation systems before processing. Recipe Importer sends URL page content or uploaded screenshots to Google Gemini via Cloudflare Workers. Published recipes and uploaded photos may also be screened by OpenAI systems for topical relevance to frozen treats. See our Privacy Policy for details on what data is sent and how it is handled.

AI outputs and extracted values are automatic, assistive, provided without warranty of any kind, and not guaranteed to be accurate. You remain responsible for reviewing recipe and nutrition information before relying on it.

Recipe Importer Outputs

Recipe Importer turns a URL or screenshot into a spin-ready recipe by extracting ingredients, quantities, nutrition values, and container size. Recipe Importer outputs are not official guidance from Ninja, SharkNinja, the original recipe author, or any appliance manufacturer. "Ninja" and "Creami" are trademarks of SharkNinja Operating LLC.

By using Recipe Importer, you acknowledge and agree that:

1. Source accuracy. SpinFreeze does not guarantee that the imported recipe accurately reflects the original source. Page parsing and image extraction are imperfect and may misread ingredients, quantities, or nutrition values.
2. Your responsibility to review. You are responsible for reviewing the imported recipe and correcting any errors before saving, freezing, or spinning.
3. No guarantee of results. SpinFreeze does not guarantee that any imported recipe will produce a particular texture, consistency, or outcome on your appliance.
4. Third-party content. Recipe Importer fetches and processes content from third-party sources you provide. You are responsible for respecting the terms, copyrights, and license restrictions of those sources.
5. Informational only. Recipe Importer outputs are for informational purposes only and do not constitute professional, technical, dietary, or safety advice.

You may not attempt to manipulate or abuse AI-powered features using misleading, harmful, or offensive inputs.

SpinFreeze may request permission to send notifications to your device. Notification permission is optional.

SpinFreeze currently uses device-local notifications for operational reminders such as pint-ready notifications and follow-up reminders. Notification delivery is best-effort only. We do not guarantee exact delivery times, delivery when your device is offline or in Do Not Disturb mode, or any specific notification format.

You are responsible for monitoring your own frozen creations, recipe timing, and food outcomes.

Certain SpinFreeze features may require a paid subscription or other in-app purchase. Pricing, feature availability, trial terms, and package options may vary by platform, geography, promotion, or time.

Subscriptions are purchased through the Apple App Store or Google Play and are subject to the billing rules of that platform. SpinFreeze may use RevenueCat to manage entitlements, restores, and cross-device access.

By purchasing a subscription, you acknowledge that:

1. billing, taxes, renewals, cancellations, and refunds are generally handled through your app-store account;
2. SpinFreeze may rely on third-party entitlement records to grant, restore, or revoke premium access;
3. temporary entitlement mismatches or delays may occur.

Unless otherwise stated, subscriptions renew automatically until canceled. You are responsible for managing and canceling your subscription through your Apple App Store or Google Play settings before the next renewal date.

Refunds, credits, chargebacks, and billing disputes are subject to the rules of the platform through which you purchased the subscription and any applicable law.

If your access is restricted or suspended due to violations of these Terms, you may not be entitled to a refund for unused subscription time, except where required by law or platform policy.

You may request account deletion in-app. The current deletion flow includes:

• an immediate sign-out;
• a 30-day grace period;
• cancellation of the deletion request if you sign back in during the grace period;
• permanent deletion after the grace period.

Deleting your account does not automatically cancel app-store subscriptions. You must cancel subscriptions separately through the Apple App Store or Google Play.

We may retain limited records after deletion where required or permitted for security, fraud or abuse prevention, disputes, legal compliance, tax and accounting, backups, and deletion workflow records.

We may also suspend or terminate your access if you violate these Terms, create security or platform risks, or misuse the service.

SpinFreeze relies on third-party services and platforms, which may include Supabase, Cloudflare, Typesense, Google, Apple, OpenAI, RevenueCat, PostHog, Sentry, Google Gemini, Open Food Facts, and Slack. Their own terms and privacy policies may also apply.

SpinFreeze does not guarantee that any specific third-party provider, authentication method, payment platform, or support channel will always be available.

We may monitor usage, performance, reliability, fraud, abuse, and security signals to operate and protect the service.

SpinFreeze is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that the service will always be uninterrupted, error-free, secure, available at all times, or compatible with every device or platform.

To the maximum extent permitted by law:

• community content may be incomplete, inaccurate, offensive, or misleading;
• search, feeds, recommendations, and AI-generated outputs may be imperfect;
• nutrition information, AI-extracted label data, and recipe information are provided for general informational purposes only;
• SpinFreeze does not provide medical, dietary, legal, tax, professional, technical, engineering, or safety advice.

You are responsible for your own decisions regarding food preparation, ingredients, dietary needs, and subscription purchases.

Health Connect and HealthKit Macro Writes

Macro values that SpinFreeze writes to Health Connect and HealthKit are informational only and are not medical advice, dietary advice, or a prescription. Third-party apps that read this data are subject to their own terms, policies, settings, and platform permissions.

Food Safety

SpinFreeze is not responsible for food safety outcomes. You are solely responsible for proper food handling, storage, and preparation; verifying ingredients are safe for you and anyone you serve; following safe food preparation practices; ensuring frozen treats are properly stored and consumed within safe timeframes; and any illness, injury, or adverse reaction resulting from food you prepare.

Recipes, freezing times, and preparation guidance provided through SpinFreeze are for informational purposes only. When in doubt, consult food safety guidelines from your local health authority.

Allergens & Dietary Restrictions

SpinFreeze does not guarantee the accuracy or completeness of allergen, ingredient, or nutrition information. User-submitted recipes may contain errors, omissions, or undisclosed allergens. AI-extracted nutrition data may be inaccurate.

If you have food allergies, intolerances, or dietary restrictions, you must independently verify all ingredients before preparing or consuming any recipe.

Macro & Ingredient Provenance

Nutrition and macro values shown for community and creator recipes are derived from the exact ingredients the creator selected, including specific branded products, barcode-scanned items, or Open Food Facts sources. Friendly ingredient labels shown in the app may drop brand names for readability, while the underlying macros still reflect the creator's chosen products.

Macro figures are estimates based on those sources and are not a substitute for reading product labels. You are responsible for verifying nutrition information against the actual products you use.

Appliance Use

SpinFreeze is designed for use with frozen dessert appliances such as the Ninja CREAMi. SpinFreeze is not affiliated with, endorsed by, or sponsored by Ninja or SharkNinja. "Ninja" and "Creami" are trademarks of SharkNinja Operating LLC.

You are responsible for reading and following your appliance manufacturer's instructions, proper use and maintenance, understanding warranty terms, and any damage or injury resulting from appliance use. SpinFreeze is not liable for appliance damage, malfunction, voided warranties, personal injury, or property damage related to appliance use.

To the maximum extent permitted by law, SpinFreeze LLC and its affiliates, service providers, licensors, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunity arising out of or related to your use of SpinFreeze.

Without limiting the foregoing, SpinFreeze is not liable for damage to, malfunction of, or reduced lifespan of any appliance; voided manufacturer warranties; personal injury or property damage; or food safety outcomes arising from your reliance on recommendations, suggestions, or guidance provided through SpinFreeze.

You use SpinFreeze's recommendations at your own risk. You are solely responsible for your appliance usage decisions.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the service will not exceed the greater of $100 or the total amount you paid SpinFreeze in the 12 months preceding the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SpinFreeze LLC and its affiliates, officers, employees, and agents from third-party claims, liabilities, damages, losses, and expenses arising out of or related to your content, your misuse of the service, your violation of these Terms, your infringement of another person's rights, or your use of any appliance in a manner that deviates from the manufacturer's instructions.

This indemnification obligation does not apply to claims arising solely from SpinFreeze's own gross negligence or willful misconduct, to the extent prohibited by applicable law.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Binding Arbitration

You and SpinFreeze agree that any dispute, claim, or controversy arising out of or relating to these Terms, the service, or your use of SpinFreeze will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring individual claims in small claims court if they qualify.

Arbitration will be administered by the AAA (American Arbitration Association) under its then-current consumer arbitration rules. The arbitration will take place in Dallas, Texas or, at your election, by videoconference. If the arbitration provider's fees exceed what you would pay in court, SpinFreeze will pay the difference to the extent required by the applicable rules.

Class Action & Jury Waiver

YOU AND SPINFREEZE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. YOU AND SPINFREEZE EACH WAIVE THE RIGHT TO A TRIAL BY JURY.

Opt-Out

You may opt out of this arbitration and class action waiver provision by sending written notice to support@spinfreeze.com within 30 days of first accepting these Terms. Your notice must include your name, SpinFreeze username, and a clear statement that you wish to opt out. If you opt out, you and SpinFreeze agree to resolve disputes in the state or federal courts located in Dallas, Texas.

Exceptions

This arbitration provision does not apply to disputes that qualify for small claims court, SpinFreeze's right to seek injunctive or equitable relief for intellectual property infringement, abuse, or security threats, or claims that applicable law does not permit to be arbitrated.

If the class action waiver is found unenforceable, the entirety of this arbitration section will be null and void. If any other provision of this section is found unenforceable, it will be severed and the remaining provisions remain in full force.

We may update these Terms from time to time. If we make material changes, we may provide notice through the app, email, website posting, or another appropriate method.

Your continued use of SpinFreeze after updated Terms take effect constitutes acceptance of the updated Terms, to the extent permitted by law.

Severability. If any provision is found unenforceable, the remaining provisions continue in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and SpinFreeze regarding the service.

No Waiver. Our failure to enforce any provision does not waive our right to enforce it in the future.

Assignment. You may not assign your rights without our written consent. We may assign ours without restriction.

Survival. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnification, limitation of liability, and dispute resolution.

No Agency. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship.

Force Majeure. SpinFreeze is not liable for failure or delay due to causes beyond our reasonable control.

Headings. Section headings are for convenience only and have no legal effect.
